N.J.’s ban on gun permits under age 21 dodges Second Amendment challenge

Gun charges against three New Jersey men have been reinstated by an appeals court ruling that sidestepped a challenge to the state’s ban on carry permits for those under 21.

The case involved three young men who were between the ages of 18 and 20 when they were charged with unlawful possession of a gun without a permit in Essex County.

The initial dismissal of the charges, based on claims that age restrictions violated Second Amendment rights, was overturned by the Appellate Division ruling.

One of the men was arrested in Newark in 2021 and the two others in a separate incident in West Orange in 2022.

Initially, the charges were dismissed due to claims that the state’s age restrictions violated their Second Amendment rights.

The Appellate Division reinstated the charges, noting that none of the defendants had applied for handgun carry permits.
