An arrest record or disposition of a criminal offense can carry a stigma with it that will affect you in job applications, credit applications and other critical areas of your day to day life.

An expungement is the removal and isolation of all records on file regarding an arrest, trial and acquittal or disposition of a criminal offense. If an Order of expungement is granted the arrest, conviction or acquittal are erased and not considered to have occurred.

New Jersey’s expungement statute, found at N.J.S.A. 2C:52-32, is very specific on who is eligible for an expungement and at what point in time. Generally, any errors in an application for expungement result in it being dismissed.
